End User Terms and Conditions for Ticket Purchases

Mountain Bike United - Event Booking

Introduction and Scope

These terms and conditions (‘Terms’) govern the relationship between you and Mountain Bike United when you purchase tickets, registrations, upgrades, add-ons or products through our platform (‘Services’). By visiting our website or mobile application and purchasing tickets, you agree to be bound by these Terms and by the Mountain Bike United Privacy Policy. You must not use or access the platform or deal with purchased tickets in violation of these Terms. If you choose not to be bound by these Terms, you must not use the platform or purchase tickets.

There may be additional terms and conditions imposed by an event organiser or venue operator in respect of an event for which you purchase tickets. It is your responsibility to review these terms prior to purchase. Mountain Bike United may vary these Terms at any time and will post variations on the platform. By continuing to use the platform after varied terms are posted, you agree to be bound by the variation.

Who We Are and What We Do

Mountain Bike United facilitates the sale of tickets, registrations, upgrades, add-ons and products by event organisers by allowing them to create event pages on our platform from which tickets can be purchased by you, and giving organisers access to a secure payment gateway. Mountain Bike United acts as an agent for the relevant event organiser.

As such, except as specified in these Terms, we are not liable for any dispute over an event or a ticket purchase. Details of the event organiser can be found on each event page. Each ticket is issued subject to the terms and conditions of the event organiser and the venue at which the event is held. You acknowledge that Mountain Bike United acts as an agent for the relevant event organiser. Any claims with respect to purchase of tickets or registrations, including cancellation or postponement of events, lie solely with the event organiser and to the extent permitted by law Mountain Bike United takes no responsibility or liability for such claims. We have no control over ticket prices, postage and handling fees or ticket delivery methods.

When you make a purchase from the platform you acknowledge and agree that all information you provide is true, accurate, and complete and will be maintained and kept up to date. It is your sole responsibility to maintain the confidentiality of any password you create for accessing content on the platform or in the course of purchasing tickets. You may only buy a maximum of 6 tickets for each event unless expressly authorised otherwise by the event organiser.

The reselling of tickets is strictly prohibited. Tickets found to be resold may be cancelled without a refund and the bearer refused entry. We reserve the right to cancel any ticket and refund the amount paid where there has been an error in ticket pricing, whether due to human error or a transactional malfunction of the platform.

The event organiser has the right to add, withdraw or, vary the advertised route, programme or content of the Event and deny admission with reasonable cause including due to intoxication, unsociable behaviour, failing to observe lawful directions, possession of invalid or insufficient tickets or identification or health and safety precautions.

No refunds or exchanges are provided for lost tickets, or for a failure on your part to redeem your ticket, including to produce sufficient proof of identity when required, sign for or print the tickets. Before you finalise your booking, please read all information that applies to the event and ticket. If you or any member of your party has particular requirements please raise these with the event organiser. There can be no guarantee that requirements can be met if notified at the event. When you receive your tickets check the details carefully. When attending the event, carry proof of age if appropriate.

Payment Terms

All credit card purchases are processed through our secure online payment system. The event organiser determines how you may pay for tickets and registrations. Tickets purchased on the platform are subject to a non-refundable per order booking fee which may, at the option of the event organiser, either be identified separately to you or included in the ticket price. In some cases, delivery prices and credit card surcharges will also be clearly identified and charged.

Unless stated to be otherwise, charges referred to for any tickets or registrations supplied via the platform are stated inclusive of VAT where relevant. A tax invoice will be provided to you upon completing your purchase of tickets where relevant. VAT means Value Added Tax which is a tax added to the value of goods in the United Kingdom. Currently this is 20 per cent. Your tax invoice will clearly show the breakdown of VAT chargeable where applicable.

All prices are stated in the currency of the event location, and your local currency. The booking fee is non-refundable in circumstances where an event is cancelled, rescheduled, changed or moved by the event organiser. Any transaction fees paid are also non-refundable in these circumstances.

Cancelled, Varied or Postponed Events

Decisions to change or cancel events are the responsibility of the event organiser. Mountain Bike United cannot guarantee to inform you of any change or cancellation of any event or be held responsible for refunds or for any resulting costs you may incur for travel, accommodation, any other related goods or services or other compensation. You should always check that an event is going ahead at the scheduled date, time and venue.

Sometimes events are cancelled, varied or postponed by the event organiser due to situations outside their control. If an event organiser cancels an event or makes significant changes to the venue, format, route, date, activities or attendees, and confirms this to Mountain Bike United, Mountain Bike United will try to inform you via app only.

We will use reasonable endeavours to ensure that the event organiser will notify us and ticket holders of a cancellation, variation or postponement. We do not guarantee that ticket holders will be informed of a variation before the date of the event.

We shall not be liable for a failure to inform you of any change or cancellation to your event where we have not been notified by the event organiser.

If an event is rescheduled, changed or moved, the event organiser will usually give you the option of either retaining or exchanging your tickets for the new date or location. Unless otherwise stated, the event organiser will offer a comparable ticket at a varied or rescheduled event, or a refund for cancelled events. Proof of purchase may be required. The event organiser is solely responsible and liable for providing any refund or comparable ticket.

Please note that the booking fee and any transaction fees are not refundable in these circumstances. If you opted for ticket refund protection this is also a non-refundable fee.

Please note that where an event is cancelled, your entry fee is at risk. This is beyond our control. We recommend that you obtain insurance for your ticket fee in the event the organiser is unable to stage the event.

Where an event is rescheduled but you do not wish to take part, all refunds must be claimed no later than 5 days before the rescheduled date. The event organiser can contact you with information relating to your tickets or the event, via the app and platform. We do not authorise the event organiser to send you any unsolicited emails, mail or spam unless you have opted in to receive further correspondence from the organiser during the ticketing process.

Refunds and Exchanges

All ticket sales are final. No exchange or refund will be given except in the case of a cancelled event. For clarification, you are not entitled to a refund if you are not satisfied with the event, you are no longer able to attend the event, you purchase a ticket in error, you arrive late or are refused entry, or there is a change in route, length of a route, number of stages or attendees.

In the unusual event where an event organiser does offer a refund due to unforeseen and extenuating circumstances, the booking fee, whether paid for by the event organiser or the customer, will not be refunded to the customer. In addition we reserve the right to levy a reasonable refund charge per order to cover administrative costs.

If for any reason you are entitled to a refund, follow the refund instructions otherwise you may not receive a refund.

In the event of a cancellation, the ticket price will be refunded onto the credit card you used to purchase the relevant tickets. To the extent permitted by law, any booking fees paid by you and any optional extras that you selected, will not be refunded.

No refunds will be offered under any circumstances if you fail to comply with all terms and conditions applicable to those tickets, the venue or the event.

Event Organiser Liability

Events are not the responsibility of Mountain Bike United. Mountain Bike United does not organise events and has no responsibility whatsoever for any loss or damage of any kind suffered at or in connection with any event, including loss, damage or theft of any personal property at an event.

The event organiser is solely responsible and liable for all aspects of the event, including but not limited to event safety, security, content, quality, cancellations, postponements, changes to the event, and any injuries, losses or damages suffered by attendees. Mountain Bike United disclaims any and all liability for the acts, omissions and conduct of any event organisers, third party users, promoters, advertisers or sponsors on the platform or otherwise related to your use of the platform. We are not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the platform. Mountain Bike United acts solely as an agent facilitating ticket sales and takes no responsibility for event-related claims.

Attending Events

Admission to an event is at all times subject to any terms, conditions or rules of the event organiser and the venue operator. If you breach those terms, conditions or rules then the event organiser or venue operator may refuse admission or require you or other ticket holders to leave the venue and you will not be entitled to a refund.

Amongst other things you will need to comply with health and safety rules and any security requirements, including security searches for the safety of those attending the event. The venue or the event organiser will have rights to refuse admission or eject you in certain circumstances and these are likely to include if you are involved with abusive, threatening, drunken or other anti-social behaviour, or carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings. There will often also be rules restricting or preventing the admission of latecomers.

Mountain Bike United will highlight any terms, conditions or rules relating to the event of which it is aware and which it considers particularly significant, onerous or unusual. This will generally include age restrictions, ticket types and similar matters. Information on where you can find full details of relevant terms, conditions or rules will be available from the event organiser or venue operator via the box office or their website or during the online booking process.

Unauthorised Use and Permitted Use

The following are examples of unauthorised use of the platform and therefore such actions constitute a breach of these Terms. You agree that you will not facilitate illegal ticket sales or use the platform to resell tickets of any kind, including by way of unauthorised framing or links to other sites for the purpose of reselling. You will not interfere with the proper working of the platform or take any action that imposes an unreasonably large burden on the platform. You will not request more than 1,000 pages of the platform in any twenty-four hour period or make any other request to transactional servers more than once during any three second interval. You will not hack into the platform or utilise automated means to process or place ticket orders including the use of robots, spiders or other devices to process ticket sales.

You may not otherwise in any form copy, reproduce, modify, create derivative works, publish or distribute the material on the platform without the prior written consent of Mountain Bike United or as permitted by applicable copyright laws.

All content, images, software and designs on the platform are owned by us or used under licence or with consent, including from event organisers. The content is protected by copyright under the laws of the United Kingdom and other countries through international treaties. You must not remove any proprietary notice or credits contained on the platform.

The platform contains trademarks, logos and trade names of Mountain Bike United which may be registered or otherwise protected by law. You must not use any trademarks, logos or trade names which are used on the platform. Nothing contained on the platform should be construed as granting any licence or right to use any trademark displayed on the platform.

We reserve all of our rights to enforce our intellectual property rights to the fullest extent of the law.

Breaches of Terms

If you breach these Terms or we believe you are or were acting in concert with any person who has done so, we may without prior notice block or limit your access to the platform, cancel any tickets, registrations or ticket orders you have placed via the platform without refund, take legal action against you, or prohibit you from future ticket or registration purchases.

Disclaimer and Limitation of Liability

You use the platform at your own risk. We do not guarantee, represent or warrant that the platform will be free of defects or bugs, or that your access will be uninterrupted, timely or error free. Your access to the platform may be suspended without notice in the case of system failure, maintenance or repair or any reason beyond our control. We reserve the right to change or discontinue any feature or service on the platform at any time.

To the extent permitted by law, we exclude all conditions and warranties relating to your use of the platform that are not set out in these Terms. The goods and services provided by Mountain Bike United come with certain guarantees that cannot be excluded under UK Consumer Law, including the Consumer Rights Act 2015. Our liability for any breach of those guarantees is limited to the replacement of goods or re-supply of services or the replacement cost of goods or re-supply of services.

As agent for the event organiser, our services to you are solely the facilitation of ticket sales. In relation to any express warranty or condition set out in these Terms in connection with goods or services supplied or offered by us via the platform, our liability to you will be limited to the amounts paid by you, if any, in respect of those goods or services.

Mountain Bike United disclaims any and all liability for the acts, omissions and conduct of any event organisers, third party users, promoters, advertisers or sponsors on the platform or otherwise related to your use of the platform. We are not responsible for the products, services, actions or failure to act of any venue, promoter or other third party in connection with or referenced on the platform.

While we will do all that is reasonable to review the appropriateness of the content on the platform, not all information and content provided by event organisers can be checked to ensure it is accurate or inoffensive. You must rely on your own enquiries as to the accuracy of information provided on the platform, including venue, route, distance, terrain, format, location, attendees, prizes and other programme information relating to the event.

The platform may contain links to third party websites which should be used at your own discretion. Mountain Bike United does not sponsor or endorse any external website. We are not responsible for the content or reliability of any linked websites and cannot guarantee that these links will work all of the time or will not contain viruses.

Indemnity

You agree to fully indemnify and hold us harmless against any expenses, costs, loss, including consequential loss, or damage that we may suffer or incur as a result of or in connection with your use of, or access to or conduct in connection with the platform, including any breach by you of these Terms.

Data Protection and Privacy

Mountain Bike United is committed to protecting your personal information in accordance with applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018. When you purchase tickets through our platform, we collect and process your personal information as described in our Privacy Policy. We act as a data controller for information we collect directly from you, and we may share your contact information with event organisers so they can contact you with information relating to your tickets or the event.

By using our Services and purchasing tickets, you agree to the processing of your personal information as described in our Privacy Policy. You have rights in relation to your personal information, including the right to access, correct, delete or restrict processing of your data. These Terms shall in all respects be governed by the laws of England and Wales. You consent to the exclusive jurisdiction of the courts of England and Wales to determine any matter or dispute which arises under these Terms.

If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from these Terms and will not affect the enforceability of the remaining provisions of these Terms.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under these Terms shall not constitute a waiver of such right.

These Terms, together with our Privacy Policy and Acceptable Use Policy and any additional terms imposed by event organisers or venue operators, constitute the entire agreement between you and Mountain Bike United relating to your use of the platform and purchase of tickets or products.

Mountain Bike United reserves the right to modify these Terms at any time. If we make changes to these Terms, we will post the revised Terms and their effective date on our platform. If we make changes we deem to be material, we will provide prominent, advance notice. If you object to any changes to these Terms, you should stop using the platform.
